This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of a computer resource.
This Agreement ("Terms & Conditions") is a legal agreement between you ("you", "your") and HAMARA RECHARGE ("hamararecharge.in", "we", "our" or "us") governing your use of HAMARA RECHARGE's services whereby HAMARA RECHARGE shall provide various online services to you.
When you use HAMARA RECHARGE services provided by us, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Agreement and shall be considered as part and parcel of this Agreement. The Privacy Policy and the Disclaimer form a part of this Agreement. We reserve the right, at our sole discretion, to change, modify, add or remove portions of this Agreement at any time without any prior written notice to you. It is your responsibility to review this Agreement periodically for updates / changes. Your continued use of HAMARA RECHARGE services following the posting of changes will mean that you accept and agree to the revisions.
This is an important document which you must consider carefully when choosing whether to use HAMARA RECHARGE Services at any time. Please read the terms of this Agreement carefully before agreeing to it. This Agreement also highlights certain risks on using the HAMARA RECHARGE Services together with guidance on how online payments through hamararecharge.in can be facilitated.
You are solely responsible for understanding and complying with any and all laws, rules and regulations of your specific jurisdiction that may be applicable to you in connection with your business and your use of the HAMARA RECHARGE Services.

Use of Content

All logos, brands, marks headings, labels, names, signatures, numerals, shapes or any combinations thereof, appearing in this site, except as otherwise noted, are properties either owned, or used under licence, by the business and / or its associate entities who feature on this Website. The use of these properties or any other content on this site, except as provided in these terms and conditions or in the site content, is strictly prohibited.
You may not sell or modify the content of this Website or reproduce, display, publicly perform, distribute, or otherwise use the materials in any way for any public or commercial purpose without the respective organisation's or entity's written permission.

Security Rules

Visitors are prohibited from violating or attempting to violate the security of the Website, including, without limitation, (1) accessing data not intended for such user or logging into a server or account which the user is not authorised to access, (2) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorisation, (3) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus or "Trojan horse" to the Website, overloading, "flooding", "mail bombing" or "crashing", or (4) sending unsolicited electronic mail, including promotions and/or advertising of products or services. Violations of system or network security may result in civil or criminal liability. The business and / or its associate entities will have the right to investigate occurrences that they suspect as involving such violations and will have the right to involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

General Rules

Visitors may not use the Website in order to transmit, distribute, store or destroy material (a) that could constitute or encourage conduct that would be considered a criminal offence or violate any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity of other personal rights of others, or (c) that is libellous, defamatory, pornographic, profane, obscene, threatening, abusive or hateful.

Indemnity

The user unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of hamararecharge.in or their breach of the terms .

Limitation of Liability

Not withstanding anything stated under this Agreement, the aggregate liability of HAMARA RECHARGE to you from any cause whatsoever shall not in any event exceed the sum equivalent to the preceding one month's aggregate Service Fees earned by HAMARA RECHARGE under this Agreement from the date of occurrence of such liability. Provided that HAMARA RECHARGE shall not be liable to you for any special, incidental, indirect or consequential damages, damages from loss of profits or business opportunities even if you have been advised in advance of the possibility of such loss, cost or damages. In no event shall HAMARA RECHARGE be liable to the Customers or any third party. In no event shall the Nodal Bank or the Acquiring Bank be liable to you in any way under this Agreement.

Disclaimer

HAMARA RECHARGE will make all reasonable efforts to provide uninterrupted service subject to down time and regular maintenance. However, not withstanding anything in this Agreement, the hamararecharge.in Site, Our Services and the provider services may not be uninterrupted or error free or free from any virus or other malicious, destructive or corrupting code, program or macro and HAMARA RECHARGE disclaim all warranties, express or implied, written or oral, including but not limited to warranties of merchantability and fitness of the services for a particular purpose. Although HAMARA RECHARGE adopts security measures it considers appropriate for the offer of our service, it does not assure or guarantee that no person will overcome or subvert the security measures and gain unauthorized access to the HAMARA RECHARGE Service or your/Customer data. HAMARA RECHARGE shall not be responsible or liable if any unauthorized person hacks into or gains access to our Service. In event of incorrect settlement in the Merchant's Account due to error on the part of hamararecharge.in, HAMARA RECHARGE shall have the right to reverse the extra funds from the Merchant Account. In addition, you shall be fully liable to return the extra funds settled within 7 (seven) days of intimation by HAMARA RECHARGE. Subject to the other clauses of this Agreement, in the event that the Settlement Amounts to be transferred to you have not been transferred, HAMARA RECHARGE shall endeavour to settle the relevant Settlement Amount to the Merchant's account within 7 (seven) days of notification from you. In addition HAMARA RECHARGE shall not be liable to you for any loss or damage whatsoever or howsoever caused or arising, directly or indirectly, including without limitation, as a result of loss of data; interruption or stoppage to the Customer's access to and/or use of the Merchant Site, HAMARA RECHARGE services and/or Payment Mechanism, interruption or stoppage of our Site, hacking or unauthorized access to the our Services, Software Application and Internet Payment Gateway, etc. Any material/information downloaded or otherwise obtained through the use of the HAMARA RECHARGE Services is done at your own discretion and risk and you will be solely responsible for any damage to its computer system or loss of data that results from the download of any such material. HAMARA RECHARGE shall have no liability in this respect.

Privacy Policy

HAMARA RECHARGE ("hamararecharge.in", "we", "our" or "us") recognizes the importance of protecting personal details and information and provides this privacy policy with respect to the access and use of www.hamararecharge.in ("Services"). For the purpose of this Privacy Policy, the user of Services may be merchants/consumers, or any other persons using Services ("User", "you" or "your"). This Privacy Policy will help you understand our policies and procedures regarding the collection, handling and use of your information.

By using our Services through the Sites, you signify your assent to this Privacy Policy and consent to the processing of your Information (Personal Information and/or Sensitive Personal Data or Information). If you do not agree with this Privacy Policy do not, in any manner, use our Services, install and/or use the mobile application.

This Privacy Policy covers our treatment of your Information collected from (i) Merchants/ Sub-Merchants who use or may want to use our recharge online portal services; and/or (ii) consumer information that we acquire in the course of our business.

As a merchant/ sub-merchant, we collect your Information, through the registration process, the service agreement that we execute and various submitted documents of your creditability that are required from time to time. We ask customers to enter personal data at the time of registration, such as name, address, phone number, and e-mail address and use this data to protect the merchant and ourselves against risk.

As a customer we capture your Profiling Information, Correspondence Information, domain name from which you contact us, the pages you request, the services you use, and the time that you spend on the site. For everyone who visits our website, we log IP addresses, and the mode of operating software you. Further, we may also capture your Service Usage and Transactional Information; one-time passwords if you have consented for it; etc.

Purpose

We respect your privacy and want to promote trust and confidence on the internet. As such, we feel it is necessary to disclose to you what information this site collects and tracks and what we do with the information that we collect. We collect and use your Information, to send you updates, to improve our Services, to improve user experience, for quicker transactions, for risk checks, for strengthening our security checks, for analysis and for offering you new features in the existing services you are availing or offering altogether new product/ service which may be relevant for you. It is clarified that the Information of Users which has been collected by us or provided to us, is the property of HAMARA RECHARGE and we may use it, in whole or in part, in our sole discretion and without any compensation to you, for any legitimate purpose and you hereby confirm that you have no objection to the aforesaid use of your Information.

Disclosure

Information security is critical to our business. We work to protect the security of your information during transmission by using data encryption technique, which encrypts information you input while using Payment Gateway. We store information gathered on secure computers. We use advanced security technology to prevent our computers from being accessed by unauthorized persons. It is important for you to protect against unauthorized access to your Login ID/password and to your computer. Be sure to protect the password used to access our services.

We use reasonable precautions to keep the personal information disclosed to us secure and do not disclose this information to other individuals or organizations. We will exchange information with other companies and organizations for the purposes of fraud protection and risk reduction. You acknowledge and agree that for the purpose of sending you updates/ communications, improving product, personalisation, offering new features in the existing services you are availing, offering new services which may be relevant for you and Service efficiency, we may, under controlled and secure circumstances, share your Information with our affiliates, associates or third parties with whom we have an legal arrangement in place.

We may disclose your Information pursuant to applicable laws, a directive or order of a government entity or statutory authority or any judicial or regulatory authority or to law enforcement agencies in any official investigation including but not limited to cyber incidents, prosecution and punishment of offences. You agree that HAMARA RECHARGE has the right to monitor and to disclose Information as may be necessary to satisfy any law, regulation or other governmental request. We may transfer Your Information or other information collected, stored, processed by HAMARA RECHARGE to any other entity or organization located in India only in case it is necessary for providing Services to You in connection with Application. We will cooperate with the appropriate law enforcement authorities in investigating claims of illegal activity.

We will only disclose your Information in accordance with this Privacy Policy. If we want to use it for any other purpose, we will obtain your consent.

If you decline to submit Information to us, then we will unfortunately not be in a position to provide the Services to you.

Security

We work to protect the security of your Information during transmission by using appropriate software, which encrypts information you input. This encrypted information is stored on secure systems/computers. We use advanced security technology to prevent our computers from being accessed by unauthorized persons.

HAMARA RECHARGE reserves the right to change, modify, add, or remove portions of this Privacy Policy at any time for any reason. In case, any changes are made in the Privacy Policy, HAMARA RECHARGE shall update the same on the website. Users should periodically review this page for the latest information on our privacy practices. Once posted, those changes are effective immediately, unless stated otherwise. Continued access or use of the Services constitutes your acceptance of the changes and the amended Privacy Policy. However, if you do not agree with the changes, please do not continue to use the Services or submit Personal Information to us.

Changes to your Information

If you (i.e. our Merchant) would like to view the information we have collected from you and your customers or you want to correct your information of your customers, please go contact us at given email id or contact number with updated details. If you have questions or suggestions, we can be reached by email. The User can at any time withdraw his/her consent given previously to HAMARA RECHARGE for collecting, receiving, possessing, storing, dealing or handling Information of the User, by sending us your request by email. In such case, HAMARA RECHARGE will unfortunately not be in a position to provide the Services to you. However, HAMARA RECHARGE will be able to retain such Information for the time period in accordance with the applicable laws.

Disclaimer

We reserve the right to report any illegal activity by any User, that is, our Merchants or their customers to law enforcement for prosecution. Please be aware that we do not control the acts of our Sub-Merchants, or customers.

Refund / Cancellation Policy

We do not issue refunds for digital service once the order is confirmed and the service is sent. We recommend contacting us for assistance if you experience any issues receiving service.
If you have any query about our Refunds Policy, please feel free to contact us at our given email address.

If in any case, you pay recharge amount, but your phone does not get recharged, we commit you to refund your money as soon as possible. If in any case, you want to cancel your order of recharge or payment soon after the payment, we may cancel your order only in case your mobile does not get recharged or your bill payment does not reach to the third party.

No cancellation is accepted if your payment is sent to the third party. If your money is deducted from your bank account, but your phone is not recharged within 24 hours, you can leave a mail to us in which you must include your email id, transaction id, order number, mobile number/ DTH account number, the recharge amount. Our customer executives will investigate the incident and if it is found that money has been deducted from your bank account, your money is refunded back to you within 7 working days after the date of receipt of email.
